By accessing or using this website, you agree to these Terms, our Privacy Policy, and any other policies linked on this site. If you do not agree, please stop using the site immediately.
4. Eligibility and Parental Supervision
To make a purchase on this website, you must be 18 years or older, or have the consent and supervision of a parent or legal guardian. Parents or guardians are responsible for all activity and purchases made by minors.
Elah Kids products are designed for children but are intended for external use under adult supervision. Adults are responsible for safe storage, appropriate use, and monitoring for any skin sensitivity or reaction.

7. Pricing
All prices are in South African Rand (ZAR). Prices may change without notice. If a pricing error occurs, we may correct or cancel affected orders and refund you in full.
8. Orders and Payment
Orders are processed after full payment is received. Accepted methods include debit/credit cards, EFT, and other gateway options shown at checkout. We may cancel orders suspected of fraud or unauthorised activity.
9. Shipping and Delivery
Delivery within South Africa typically takes 2–5 working days depending on location. You’ll receive a tracking link once dispatched. We commit to delivering all orders within 30 days of the order date, unless a different timeframe is expressly agreed at checkout. We are not liable for courier delays, incorrect addresses, or events beyond our control. International shipping (if offered) may incur customs fees and longer timelines.
10. Returns and Exchanges
A. 7-Day Cooling-Off Right
In terms of the Electronic Communications and Transactions Act (ECTA), you may cancel your order and return products for a full refund within 7 days of delivery for any reason (“change of mind”), provided that the goods are unused, unopened, and in their original, resalable condition. You are responsible for the direct cost of returning the goods unless the return results from our error or a defective product. Due to hygiene regulations, opened skincare or haircare products cannot be returned under this right.
B. Defective Goods (6-Month CPA Warranty with 30-Day Reporting Requirement)
In accordance with Section 56 of the Consumer Protection Act (CPA), all products carry a six-month implied warranty of quality covering manufacturing defects existing at the time of sale. Because Elah Kids products are consumable in nature, defects or packaging faults must be reported within 30 days of delivery to qualify for assessment under this warranty. Claims made after this period may reasonably indicate wear-and-tear or use-related damage rather than a manufacturing fault and will be handled at our discretion.
11. Product Safety and Use
Our products comply with safety standards and are formulated for sensitive skin and scalp types. Follow label directions and consider a patch test. Discontinue use if irritation occurs and consult a healthcare professional. Products are not intended to diagnose, treat, or cure medical conditions.
12. Promotions, Gift Cards and Vouchers
Promotional codes, discounts, and gift cards are valid only for the stated period and terms. They cannot be exchanged for cash or combined with other offers unless specified. Lost or stolen vouchers cannot be replaced. We may modify or cancel promotions at any time.
13. Intellectual Property
All site content—text, graphics, logos, images, icons, videos, data, software, and layouts—is protected by copyright, design, and trademark laws. Elah Kids (Pty) Ltd retains ownership of all intellectual-property rights in the site and its content. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the site for personal, non-commercial purposes. We are not liable for any failure or delay in performance resulting from events beyond our reasonable control, including acts of God, natural disasters, strikes, labour disputes, wars, civil disturbances, pandemics, transport disruptions, supplier failures, or governmental actions.
24. Reviews and User Content
When you submit reviews, comments, photos, or other content (“User Content”), you grant Elah Kids a non-exclusive, royalty-free, transferable, sublicensable, worldwide, perpetual licence to use, reproduce, modify, adapt, publish, translate, and display such content in any media for marketing and operational purposes. You represent that you own or control all rights to your User Content and that it is accurate and lawful.
25. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the exclusive jurisdiction of South African courts.
